For and in consideration of Participant’s registration with the Winnetka Hockey Club (“WHC”) and being allowed to participate in WHC events and member team activities (which for purposes of this agreement include, but are not limited to all all-star and house league games, practices and scrimmages), the undersigned parent or legal guardian of Participant, on behalf of Participant and Participant’s parents and legal guardians, waive and relinquish any and all liability for and cause of action for personal injury, property damage, or wrongful death occurring to Participant arising out of, on account of or in relation to, directly or indirectly, participation in WHC events or member team activities or the sport of ice hockey, and activities incidental thereto, wherever and however they occur and for such period said activities may continue, and by this agreement any such claims, rights and causes of action that Participant may have against the WHC, or which his parents or legal guardians may have, are hereby waived and relinquished.

Participant and his parents or legal guardians acknowledge, understand and assume all risks inherent in ice hockey and any member team activities, and understand that said sport and activities involve risks to Participant’s person including bodily injury, partial or total disability, paralysis and death, and damages which may arise therefrom, and that they have full knowledge of said risks. These risks and dangers may be caused by thenegligence of Participant or the negligence of others, including those parties being released by this agreement. It is further acknowledged that there may be risks and dangers not known or reasonably foreseeable at this time.

For purposes of this agreement, the WHC includes its officers, directors, employees, coaches and assistant coaches (both paid and voluntary), other participants, officials and sponsors.

IT IS THE INTENTION OF THIS AGREEMENT TO EXEMPT, WAIVE AND RELEASE THE WHC FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE AND WRONGFUL DEATH CAUSED BY NEGLIGENCE, INCLUDING THE NEGLIGENCE OF THE WHC. THE UNDERSIGNED ACKNOWLEDGES THAT HE/SHE HAS READ THIS DOCUMENT, AND HAS NOT RELIED UPON ORAL OR WRITTEN REPRESENTATIONS OF THE WHC WHICH ARE INCONSISTENT WITH THAT CONTAINED IN THIS DOCUMENT, THAT HE/SHE IS FULLY APPRISED OF THE POTENTIAL DANGERS OF ICE HOCKEY AND THAT HE/SHE SIGNS THIS DOCUMENT VOLUNTARILY, UNDERSTANDING THAT THE WAIVER, RELEASE AND ASSUMPTION OF RISK SET FORTH HEREIN IS NECESSARY TO ALLOW AMATEUR HOCKEY TO EXIST IN ITS PRESENT FORM.
